TERMS AND CONDITIONS: GENERAL CONDITIONS FOR THE USE OF SERVICES OFFERED BY MOMASOFT SRL THROUGHT THE WEB SITE WWW MOMAPIX.COM


Momasoft Srl, with headquarters in Rome, Via A. da Giussano 61/A-B, is the company which owns the trademark MOMAPIX and the web sites http://www.momapix.com through which it supplies the service to its clients.

Clients are defined as the subjects, physical or juridical, who ask for and obtain from MomaSoft Srl the right to use MomaPIX software housed on the servers specified in the previous paragraph.

All the services offered by MomaSoft are intended to be used only for legally-recognized purposes. MomaSoft is in no way responsible for the publication on its servers of material that the clients have at their disposal.  
The registration and presentation on MomaSoft servers of material in violation of national and international laws is forbidden. 

Pornography and the merchandising of pornographic material through the MomaSoft servers is forbidden. This includes images with a sexual content or links to sites with material for adults only.

MomaSoft is the only arbitrator for anything concerning the violation of the terms stated above. Contents which do not satisfy the above specifications will be removed without warning and the accounts of the clients concerned suspended.

MomaSoft, through commercial agreements with its suppliers, undertakes to ensure that the servers by which its supplies its service to clients functions regularly throughout the entire year, 24 hours a day and including holidays, except in the case of unforeseeable interruptions to the service caused by events beyond its control and for which it has no responsibility. These might include: interruption or malfunctioning of the telecommunications system or transmission circuits, hostile attacks on the server, congestion or interruption to the net.

MomaSoft, by way of commercial agreements with suppliers, pledges to safeguard the personal details of clients.

MomaSoft has the right to intervene at any moment on the servers housing the MomaPIX service for maintenance operations carried out to ensure the best possible service and security conditions. Should planned interventions cause a temporary interruption to the service, MomaSoft undertakes to warn al clients within 48 hours of the intervention.

The client has the right to the correct functioning of the server in accordance with the model chosen and within the limits indicated in the previous paragraphs. The client is the exclusive responsable for keeping backup copies of images sent to the MomaSoft server through the MomaPIX software. Any request for compensation by the client cannot exceed the amount the said client paid for the current period of subscription.

The general conditions presented here represent a binding agreement between MomaSoft and the client. Clients who sign the above agreement for the service explicitly declare that they are aware of and accept the conditions listed.

The parties involved explicitly agree that any and all disputes related to the interpretation and implementation of the conditions as presented above will be considered under the jurisdiction of the Foro di Roma (the Rome Court of Justice).
